Bu Kullanım Şartları ("Şartlar"), Vescovia mobil uygulamasını ("Vescovia", "uygulama", "biz", "hizmet") kullanımınızı düzenler. Uygulamayı indirerek, hesap oluşturarak veya kullanarak bu Şartları kabul etmiş olursunuz. Kabul etmiyorsanız uygulamayı kullanmamalısınız.

Vescovia tıbbi tavsiye vermez

Vescovia yalnızca bilgilendirme ve kişisel takip amaçlıdır. Uygulamadaki kalori/makro hedefleri, ilerleme tahminleri ve AI destekli öneriler (fotoğrafla yemek tanıma, tarif önerileri, haftalık geri bildirim) tıbbi, beslenme veya sağlık tavsiyesi yerine geçmez ve bir hekim, diyetisyen veya uzmanın değerlendirmesinin yerini almaz. Kilo verme/alma hedefi, kronik bir sağlık durumu, gebelik, yeme bozukluğu öyküsü veya herhangi bir tıbbi endişeniz varsa uygulamayı kullanmadan önce ve kullanırken bir sağlık uzmanına danışın. Kendinizi kötü hissediyorsanız veya yeme alışkanlıklarınızla ilgili endişeliyseniz lütfen bir uzmandan destek alın.

1. Hizmetin tanımı

Vescovia; kalori/makro besin takibi, barkod tarama, fotoğrafla AI yemek tanıma, tarif önerileri, haftalık AI koç geri bildirimi, oruç takibi, egzersiz logu, sosyal (arkadaş) özellikler ve ilgili takip araçlarını sunan bir mobil uygulamadır.

2. Yapay zeka özellikleri hakkında

Fotoğrafla yemek tanıma, tarif önerileri ve haftalık AI koç özellikleri büyük dil modelleri (OpenAI) kullanılarak üretilir. Bu özelliklerin çıktıları:

  • tahminidir — gerçek kalori/gramaj/makro değerlerinden sapabilir;
  • belirttiğiniz alerjen/beslenme kısıtlamalarını dikkate almaya çalışır ama hata yapabilir — bir tarifi uygulamadan veya bir tahmine güvenmeden önce içeriği/malzemeleri kendiniz kontrol etmelisiniz;
  • tıbbi veya beslenme uzmanı tavsiyesi değildir.

AI çıktılarına dayanarak aldığınız kararlardan (alerjik reaksiyon, yanlış kalori takibi vb. dahil) doğabilecek sonuçlardan Vescovia sorumlu tutulamaz — bkz. Bölüm 9.

3. Uygunluk ve yaş sınırı

Vescovia'yı kullanmak için en az 16 yaşında olmanız gerekir. Uygulama, 16 yaşın altındaki kullanıcılara yönelik değildir ve bu yaş grubuna hizmet vermeyi amaçlamaz. Bu yaş sınırının altında olduğunuzu fark edersek hesabınızı kapatabiliriz.

4. Hesap ve güvenlik

Hesap bilgilerinizin (e-posta, şifre) gizliliğinden ve hesabınız altında gerçekleşen tüm etkinlikten siz sorumlusunuz. Hesabınızla ilgili yetkisiz bir kullanım fark ederseniz bize privacy@vescovia.com adresinden bildirin.

5. Abonelik, ücretlendirme ve iptal

  • Vescovia, ücretsiz bir katman ve isteğe bağlı ücretli Premium aboneliği sunar (aylık veya yıllık plan).
  • Premium abonelik genellikle 3 günlük ücretsiz deneme ile başlar; deneme süresi bitmeden iptal etmezseniz abonelik otomatik olarak ücretli döneme geçer ve seçtiğiniz plana göre (aylık/yıllık) ücretlendirilirsiniz.
  • Ödemeler ve otomatik yenileme, Google Play/App Store'un abonelik altyapısı üzerinden işlenir — fiyat, yenileme tarihi ve iptal seçenekleri satın almadan önce mağaza arayüzünde gösterilir.
  • Aboneliğinizi istediğiniz zaman Google Play/App Store hesap ayarlarından iptal edebilirsiniz; iptal, mevcut faturalama döneminin sonunda geçerli olur, kısmi iade yapılmaz (mağazanın kendi iade politikası saklı kalmak kaydıyla).
  • Uygulama içinde hesabınızı silmeniz (Ayarlar → "Hesabımı Sil") aktif aboneliğinizi otomatik iptal etmez — bunu ayrıca mağaza üzerinden yapmanız gerekir.
  • Fiyatlar önceden haber verilmeksizin değişebilir; mevcut faturalama dönemi içindeki fiyat değişikliği bir sonraki yenilemeye kadar uygulanmaz.

6. Kabul edilebilir kullanım

Vescovia'yı şu şekillerde kullanmamayı kabul edersiniz:

  • Yasa dışı bir amaçla veya başkalarının haklarını ihlal edecek şekilde;
  • Hizmetin altyapısına zarar verecek, aşırı yük bindirecek veya tersine mühendislik yapmaya çalışacak şekilde;
  • Başka bir kullanıcının hesabına yetkisiz erişim sağlamaya çalışarak;
  • AI özelliklerini (fotoğraf analizi, tarif önerisi, haftalık koç) amacı dışında, kötüye kullanım veya aşırı otomatik istek yoluyla kullanarak.

Bu kuralları ihlal ettiğinizi tespit edersek hesabınızı askıya alabilir veya kapatabiliriz.

7. Fikri mülkiyet

Vescovia uygulaması, markası ve logosu bize aittir; bu Şartlar size yalnızca uygulamayı kişisel, ticari olmayan amaçlarla kullanma hakkı tanır. Uygulamadaki besin/barkod verilerinin bir kısmı Open Food Facts topluluk veritabanından, Open Database License (ODbL) kapsamında sağlanmaktadır.

8. Üçüncü taraf hizmetler

Vescovia; Supabase, OpenAI, RevenueCat, Open Food Facts ve Google AdMob gibi üçüncü taraf hizmetleri kullanır (bkz. Gizlilik Politikası Bölüm 3). Bu hizmetlerin kullanılabilirliği veya doğruluğu bizim doğrudan kontrolümüzde değildir; bu hizmetlerdeki kesinti veya hatalardan doğabilecek dolaylı zararlardan sorumlu değiliz.

9. Sorumluluğun sınırlandırılması

Vescovia, "OLDUĞU GİBİ" ve "MÜSAİT OLDUĞU ŞEKİLDE" sunulur, açık veya zımni hiçbir garanti verilmez (belirli bir amaca uygunluk, kesintisiz/hatasız çalışma dahil ancak bunlarla sınırlı olmamak üzere). Yürürlükteki mevzuatın izin verdiği azami ölçüde:

  • Vescovia; uygulamanın kullanımından, AI çıktılarına dayanarak alınan kararlardan, veri kaybından veya hizmet kesintisinden doğan dolaylı, arızi, özel veya sonuç niteliğindeki zararlardan sorumlu tutulamaz;
  • Toplam sorumluluğumuz, varsa, son 12 ayda Vescovia'ya ödediğiniz toplam abonelik ücretini aşamaz.

Bazı yargı bölgeleri belirli garanti hariç tutmalarına veya sorumluluk sınırlamalarına izin vermez; bu durumda yukarıdaki sınırlamalar sizin için yalnızca ilgili yasanın izin verdiği ölçüde geçerli olur.

10. Fesih

Bu Şartları ihlal etmeniz halinde hesabınızı askıya alma veya kapatma hakkımız saklıdır. Hesabınızı istediğiniz zaman Ayarlar → "Hesabımı Sil" ile kendiniz de kapatabilirsiniz (bkz. Gizlilik Politikası Bölüm 4).

11. Uygulanacak hukuk ve uyuşmazlık çözümü

Bu Şartlar, yürürlükteki tüketici mevzuatının aksine bir hüküm içermediği sürece, ikametgahınızın bulunduğu ülkenin/eyaletin mevzuatına tabidir. Bir uyuşmazlık çıkması halinde önce privacy@vescovia.com üzerinden bizimle iletişime geçerek dostane çözüm aramanızı rica ederiz; bu, yürürlükteki hukukun size tanıdığı diğer hakları ortadan kaldırmaz.

12. Bu şartlardaki değişiklikler

Bu Şartları zaman zaman güncelleyebiliriz. Önemli değişikliklerde uygulama içinden veya e-posta yoluyla sizi bilgilendireceğiz. Güncel sürüm her zaman bu sayfada yer alır. Değişiklikten sonra uygulamayı kullanmaya devam etmeniz, güncellenmiş Şartları kabul ettiğiniz anlamına gelir.

These Terms of Service ("Terms") govern your use of the Vescovia mobile app ("Vescovia", "the app", "we", "the service"). By downloading, creating an account for, or using the app, you agree to these Terms. If you do not agree, do not use the app.

For details on how we collect and use data, also read our Privacy Policy — together, these two documents form our agreement with you.

Vescovia does not provide medical advice

Vescovia is intended for informational and personal tracking purposes only. The calorie/macro targets, progress projections, and AI-generated suggestions in the app (photo food recognition, recipe suggestions, weekly feedback) do not constitute medical, nutritional, or health advice and are not a substitute for the judgment of a physician, registered dietitian, or other qualified professional. If you have a weight-related goal, a chronic health condition, are pregnant, have a history of disordered eating, or any other medical concern, consult a qualified professional before and while using the app. If you feel unwell or are concerned about your relationship with food, please seek support from a professional.

1. Description of the service

Vescovia is a mobile app offering calorie/macro nutrition tracking, barcode scanning, AI-powered photo food recognition, recipe suggestions, weekly AI coach feedback, fasting tracking, exercise logging, social (friends) features, and related tracking tools.

2. About the AI features

Photo food recognition, recipe suggestions, and weekly AI coach feedback are generated using large language models (OpenAI). Outputs from these features:

  • are estimates — they may deviate from actual calorie/gram/macro values;
  • attempt to honor the allergens/dietary restrictions you set, but can make mistakes — you must independently verify ingredients/content before acting on a recipe or estimate;
  • are not medical or professional nutrition advice.

Vescovia is not liable for outcomes (including allergic reactions or inaccurate nutrition tracking) resulting from decisions made based on AI outputs — see Section 9.

3. Eligibility and age requirement

You must be at least 16 years old to use Vescovia. The app is not directed at, and does not intend to serve, users under this age. If we become aware that you are under this age, we may close your account.

4. Account and security

You are responsible for keeping your account credentials (email, password) confidential and for all activity under your account. If you notice unauthorized use of your account, notify us at privacy@vescovia.com.

5. Subscriptions, billing, and cancellation

  • Vescovia offers a free tier and an optional paid Premium subscription (monthly or annual plan).
  • Premium typically starts with a 3-day free trial; unless you cancel before the trial ends, the subscription automatically converts to a paid period and you are charged according to your selected plan (monthly/annual).
  • Payments and auto-renewal are processed through Google Play's/ Apple App Store's subscription infrastructure — price, renewal date, and cancellation options are shown in the store interface before purchase.
  • You may cancel your subscription at any time via your Google Play/App Store account settings; cancellation takes effect at the end of the current billing period, and no partial refunds are given (subject to the store's own refund policy).
  • Deleting your account in-app (Settings → "Delete My Account") does not automatically cancel an active subscription — you must do that separately via the store.
  • Prices may change without prior notice; a price change during your current billing period will not apply until your next renewal.

6. Acceptable use

You agree not to use Vescovia to:

  • Engage in unlawful activity or infringe others' rights;
  • Damage, overload, or attempt to reverse-engineer the service's infrastructure;
  • Attempt unauthorized access to another user's account;
  • Misuse the AI features (photo analysis, recipe suggestions, weekly coach) outside their intended purpose, including via abusive or excessive automated requests.

We may suspend or terminate your account if we determine you have violated these rules.

7. Intellectual property

The Vescovia app, brand, and logo are owned by us; these Terms grant you only a personal, non-commercial license to use the app. Some of the food/barcode data in the app is provided by the Open Food Facts community database under the Open Database License (ODbL).

8. Third-party services

Vescovia relies on third-party services including Supabase, OpenAI, RevenueCat, Open Food Facts, and Google AdMob (see Privacy Policy, Section 3). Their availability or accuracy is not within our direct control; we are not liable for indirect damages arising from outages or errors in these services.

9. Limitation of liability

Vescovia is provided "AS IS" and "AS AVAILABLE", without warranties of any kind, express or implied (including, without limitation, fitness for a particular purpose or uninterrupted/ error-free operation). To the maximum extent permitted by applicable law:

  • Vescovia is not liable for indirect, incidental, special, or consequential damages arising from your use of the app, decisions made based on AI outputs, data loss, or service interruption;
  • our total liability, if any, will not exceed the total subscription fees you paid to Vescovia in the preceding 12 months.

Some jurisdictions do not allow certain warranty exclusions or liability limitations; in that case the above limitations apply to you only to the extent permitted by applicable law.

10. Termination

We reserve the right to suspend or close your account if you violate these Terms. You may also close your account yourself at any time via Settings → "Delete My Account" (see Privacy Policy, Section 4).

11. Governing law and dispute resolution

Unless applicable consumer protection law provides otherwise, these Terms are governed by the laws of the country/state of your residence. If a dispute arises, please first contact us at privacy@vescovia.com to seek an amicable resolution; this does not remove any other rights applicable law grants you.

12. Changes to these terms

We may update these Terms from time to time. We'll notify you of material changes in-app or by email. The current version always lives on this page. Continuing to use the app after a change means you accept the updated Terms.
